Welcome to Becca’s Rental List. These Terms of Service (“Terms”) govern your access to and use of the Becca’s Rental List website, account dashboard, rental search tools, property information, subscription features, alerts, databases, maps, and other related services (collectively, the “Service”).

Please read these Terms carefully.

By accessing the Service, creating an account, purchasing a subscription, or otherwise using Becca’s Rental List, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use the Service.

1. About Becca’s Rental List

Becca’s Rental List is an online rental discovery and information platform primarily designed to help users research and discover rental housing opportunities, including properties in New York City.

Depending on your account and subscription level, the Service may provide access to features including:

rental listings;
rental search and filtering;
property information;
building information;
landlord information;
rent-stabilized property information;
neighborhood and geographic information;
interactive maps;
listing history and status information;
saved listings;
saved searches;
rental alerts;
market-related information; and
other rental research tools.

Becca’s Rental List is primarily an information and technology platform.

Unless expressly stated otherwise, Becca’s Rental List does not own, lease, manage, inspect, represent, or control the rental properties displayed through the Service and is not the landlord, property manager, real estate broker, or leasing agent for those properties.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or purchase a paid subscription.

By using the Service, you represent that:

you meet these eligibility requirements;
the information you provide is accurate;
your use of the Service complies with applicable law; and
you have authority to agree to these Terms.

3. User Accounts

Certain features require a registered account.

You agree to provide accurate, current, and complete information when creating and maintaining your account.

You are responsible for:

protecting your login credentials;
maintaining the security of your account;
activity occurring through your account; and
notifying us promptly if you suspect unauthorized access.

You may not sell, transfer, sublicense, or otherwise provide your account to another person without our permission.

We may restrict, suspend, or terminate accounts that we reasonably believe are being used fraudulently, unlawfully, abusively, or in violation of these Terms.

4. Rental Listing Information

Becca’s Rental List may collect, organize, normalize, categorize, aggregate, enrich, and display rental information obtained from multiple sources.

Information may include:

property address;
rental price;
bedrooms and bathrooms;
square footage;
amenities;
photographs;
property descriptions;
geographic coordinates;
neighborhood;
borough;
listing status;
availability information;
listing history;
building information;
landlord or management information;
contact information associated with a listing; and
other rental-related information.

Information displayed through the Service may originate from third-party listing websites, publicly accessible sources, public records, data providers, landlords, property managers, agents, brokers, or other sources.

5. Accuracy and Availability of Listings

Rental markets change quickly.

A property displayed as available through Becca’s Rental List may become unavailable before our systems detect the change.

Similarly:

rental prices may change;
concessions may expire;
listing descriptions may change;
photographs may become outdated;
landlord or management information may change;
amenities may differ;
property availability may change;
listings may be removed or relisted; and
information obtained from third parties may contain errors.

We make reasonable efforts to maintain useful and current information, but we do not guarantee that every listing or property record is accurate, complete, current, or available.

You should independently verify important information with the landlord, property manager, broker, agent, listing provider, or other appropriate source before making a rental decision.

6. Listing Statuses

Becca’s Rental List may use automated and manual systems to classify listings according to their apparent availability or condition.

Statuses may indicate that a listing is active, new, changed, relisted, potentially unavailable, unavailable, expired, undergoing processing, or otherwise classified by our systems.

These statuses are informational estimates and should not be interpreted as guarantees of availability.

A property appearing as “Active,” for example, does not guarantee that it remains available when you contact the relevant property representative.

7. Rent-Stabilized Information

The Service may provide information relating to properties or buildings that appear in rent-stabilization records or databases.

This information is provided for research and informational purposes.

The presence of a building in a rent-stabilized database does not necessarily mean that every apartment in that building is currently rent stabilized or that a particular advertised apartment is subject to rent stabilization.

Likewise, the absence of a property from information available through Becca’s Rental List does not conclusively establish that an apartment is not rent stabilized.

Users should verify the regulatory status of a specific apartment through appropriate government agencies, official records, qualified professionals, or other authoritative sources.

Becca’s Rental List does not provide legal advice regarding rent stabilization, tenant rights, rent regulation, leases, or housing law.

8. Landlord and Building Information

The Service may provide information concerning landlords, property owners, management companies, buildings, and other entities associated with rental properties.

Such information may be compiled from multiple sources and may occasionally be incomplete, outdated, duplicated, or incorrectly associated with a property.

This information is intended to assist rental research and should not be treated as a definitive legal determination of property ownership or management responsibility.

Users should independently verify information when it is material to a rental decision.

9. Maps and Location Information

Becca’s Rental List may provide maps, property coordinates, neighborhood boundaries, distances, and other geographic information.

Map and location information may rely on third-party mapping and geocoding providers.

Coordinates, boundaries, distances, neighborhood classifications, and similar information may contain inaccuracies.

Map information is provided as a convenience and should not be relied upon for legal property boundaries or other purposes requiring precise geographic information.

10. Search, Filtering, and Recommendations

The Service may allow users to search and filter rental properties based on criteria including:

location;
price;
bedrooms;
bathrooms;
amenities;
rental type;
listing status;
property characteristics; and
other available attributes.

Search results may be generated using automated systems.

The order or visibility of results does not constitute an endorsement or guarantee by Becca’s Rental List.

We may modify our search, filtering, ranking, recommendation, and categorization systems at any time.

11. Saved Listings and Searches

Registered users may be able to save properties, searches, filters, or other preferences.

We do not guarantee permanent storage of saved information.

Features may change, and saved information may occasionally become unavailable because of listing removal, account changes, technical problems, data updates, or other circumstances.

Users should not rely on Becca’s Rental List as their sole method of retaining important rental information.

12. Rental Alerts and Notifications

Certain accounts may allow users to receive notifications regarding:

new rental listings;
changes to listings;
saved searches;
price changes;
availability changes; or
other rental-related information.

Alerts are provided for convenience.

We do not guarantee that every matching property will trigger an alert or that alerts will be delivered immediately.

Delivery may be affected by technical systems, email providers, notification settings, third-party services, or other factors outside our control.

13. Subscription Plans

Becca’s Rental List may offer free and paid account levels.

Features available to each subscription level may differ.

Paid plans may provide access to additional features such as advanced search capabilities, property information, landlord information, building information, rental databases, map functionality, alerts, or other premium tools.

The features included in each plan will be described on the applicable pricing or subscription page.

We may modify plan features, limits, or availability as the Service evolves, subject to applicable law and any commitments made regarding an existing paid subscription.

14. Fees and Billing

Certain features require payment.

By purchasing a paid subscription, you agree to pay the price displayed at the time of purchase together with any applicable taxes or charges.

Payments may be processed through a third-party payment provider.

You authorize us and/or our payment processor to charge your selected payment method for amounts associated with your subscription.

You agree to provide accurate and current billing information.

15. Recurring Subscriptions and Renewals

If you purchase a recurring subscription, your subscription may automatically renew at the end of each applicable billing period unless you cancel it before the renewal date.

By purchasing a recurring subscription, you authorize the applicable recurring charges disclosed during checkout.

Your subscription will continue until canceled in accordance with the cancellation process made available through the Service.

We may send subscription, renewal, billing, or cancellation communications electronically.

16. Cancellation

You may cancel a recurring subscription using the account or subscription-management functionality made available through the Service or by contacting customer support where appropriate.

Unless otherwise stated or required by law, cancellation generally prevents future renewal charges rather than retroactively canceling the current billing period.

After cancellation, you may retain access to paid features until the end of your then-current paid billing period.

17. Refunds

Except where required by applicable law or expressly stated otherwise at the time of purchase, subscription payments are generally non-refundable after a billing period has begun.

If you believe you were charged incorrectly, contact us promptly so that we can review the transaction.

Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

18. Changes to Pricing

We may change subscription pricing from time to time.

Pricing changes generally will not retroactively alter amounts already paid.

Where required by law, we will provide notice before a new price applies to an existing recurring subscription.

If you do not agree to a pricing change, you may cancel your subscription before the new pricing becomes applicable.

19. Acceptable Use

You may use Becca’s Rental List for lawful rental research and related purposes.

You agree not to:

violate applicable laws or regulations;
attempt unauthorized access to accounts or systems;
interfere with the operation or security of the Service;
distribute malware or harmful code;
impersonate another person;
use another person’s account without authorization;
circumvent subscription or access controls;
attempt to bypass feature restrictions;
fraudulently obtain paid functionality;
use the Service to harass or harm others;
use information obtained from the Service for unlawful discrimination;
interfere with other users’ use of the Service; or
use the Service in connection with fraudulent or deceptive activity.

20. Automated Access, Scraping, and Data Extraction

Except where expressly authorized by us in writing, you may not use automated systems to systematically extract, copy, reproduce, download, monitor, or harvest substantial portions of the Service or its databases.

This includes unauthorized use of:

bots;
crawlers;
spiders;
scrapers;
automated browser systems;
bulk download tools; or
similar technologies.

You also may not attempt to circumvent technical measures intended to control access to the Service.

This restriction does not prohibit ordinary indexing by generally recognized search engines where such indexing complies with our technical instructions and applicable law.

21. Fair Housing and Non-Discrimination

You may not use Becca’s Rental List in a manner that violates applicable fair-housing or anti-discrimination laws.

You may not use information or functionality provided through the Service to unlawfully discriminate against any person based on a characteristic protected under applicable federal, state, or local law.

Becca’s Rental List does not endorse discriminatory rental practices.

22. No Brokerage or Agency Relationship

Unless expressly stated otherwise, Becca’s Rental List is not acting as your:

real estate broker;
real estate agent;
landlord;
property manager;
attorney;
financial adviser; or
representative.

Use of the Service does not create a brokerage, agency, fiduciary, landlord-tenant, attorney-client, or similar professional relationship between you and Becca’s Rental List.

23. No Guarantee of Rental

Using Becca’s Rental List does not guarantee that:

you will obtain an apartment;
a landlord will respond to you;
you will qualify for a property;
an application will be accepted;
the advertised price will remain available;
an apartment will remain available; or
a rental transaction will be successfully completed.

Rental decisions are made independently by landlords, property managers, agents, brokers, owners, or other relevant parties.

24. No Legal, Financial, or Real Estate Advice

Content available through Becca’s Rental List is provided for general informational purposes.

Nothing available through the Service constitutes legal, financial, tax, investment, real estate, or other professional advice.

You should consult an appropriately qualified professional regarding decisions requiring professional advice.

25. Third-Party Websites and Services

The Service may contain links to third-party websites or services.

These may include property websites, listing sources, mapping providers, payment processors, landlords, management companies, brokers, agents, or other services.

We do not control third-party services and are not responsible for their:

content;
availability;
security;
privacy practices;
pricing;
representations;
products; or
services.

Your interaction with a third party is governed by your relationship and agreements with that third party.

26. Intellectual Property

The Becca’s Rental List platform, including its software, interface, design, branding, original content, databases, organization, functionality, and other proprietary materials, is protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, license, publicly display, reverse engineer, or create derivative works from our proprietary materials.

Third-party listing content, photographs, trademarks, and other materials may remain the property of their respective owners.

Nothing in these Terms transfers ownership of third-party intellectual property to Becca’s Rental List.

27. Feedback

If you voluntarily provide suggestions, ideas, recommendations, or feedback regarding Becca’s Rental List, you permit us to use that feedback to improve or develop the Service without an obligation to compensate you, unless otherwise agreed in writing.

28. Privacy

Your use of Becca’s Rental List is also governed by our Privacy Policy, which explains how we collect, use, disclose, store, and protect information.

The Privacy Policy is incorporated into these Terms by reference where legally appropriate.

29. Service Availability

We work to maintain a reliable Service but cannot guarantee uninterrupted availability.

The Service may occasionally be unavailable because of:

maintenance;
software updates;
infrastructure problems;
third-party outages;
network failures;
security incidents;
data-provider interruptions; or
circumstances outside our reasonable control.

We may modify, suspend, replace, or discontinue portions of the Service as it evolves.

30. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

BECCA’S RENTAL LIST DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

EVERY LISTING IS ACCURATE;
EVERY LISTING IS CURRENT;
A PROPERTY IS AVAILABLE;
PRICING IS CORRECT;
THIRD-PARTY INFORMATION IS COMPLETE;
THE SERVICE WILL ALWAYS BE AVAILABLE;
THE SERVICE WILL BE ERROR-FREE; OR
USING THE SERVICE WILL RESULT IN A SUCCESSFUL RENTAL.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

31. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BECCA’S RENTAL LIST AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

This includes, where legally permissible, losses arising from:

inaccurate listing information;
unavailable properties;
third-party conduct;
missed rental opportunities;
interruption of the Service;
loss of information;
unauthorized account access; or
reliance on information displayed through the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

(A) the amount you paid to Becca’s Rental List during the twelve months immediately preceding the event giving rise to the claim; or

(B) $100.

Nothing in these Terms excludes liability that cannot legally be excluded.

32. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Becca’s Rental List and its affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, and reasonable expenses arising from:

your unlawful use of the Service;
your material violation of these Terms;
your infringement of another person’s rights; or
fraudulent or malicious activity conducted through your account.

33. Suspension and Termination

We may suspend, restrict, or terminate access to the Service when we reasonably believe that:

these Terms have been violated;
an account is being used fraudulently;
payment is overdue or reversed;
the Service is being abused;
our systems or users are at risk;
applicable law requires us to do so; or
continued access could cause material harm.

Where appropriate and legally required, we may provide notice or an opportunity to resolve the issue.

You may stop using the Service at any time.

34. Effect of Termination

When an account is terminated, access to account-specific or subscription functionality may end.

Certain provisions of these Terms will survive termination where their nature requires them to survive, including provisions concerning intellectual property, disclaimers, liability, dispute resolution, and other accrued rights and obligations.

Personal information associated with a terminated account will be handled in accordance with our Privacy Policy and applicable retention requirements.

35. Changes to the Service

Becca’s Rental List will continue to evolve.

We may add, remove, modify, redesign, or discontinue features.

Not every feature will necessarily be available to every user, subscription level, geographic area, or device.

We may also change third-party integrations and data sources.

36. Changes to These Terms

We may update these Terms periodically to reflect changes in:

the Service;
subscription offerings;
applicable laws;
technology;
security requirements;
business practices; or
third-party services.

The “Last Updated” date at the top of these Terms indicates the latest revision.

If we make material changes, we may provide additional notice where appropriate or required by law.

Your continued use of the Service after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

37. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.

38. Dispute Resolution

Before initiating formal proceedings, you and Becca’s Rental List agree to make a reasonable effort to resolve disputes informally.

A party seeking to raise a dispute should provide written notice describing the nature of the dispute and requested resolution.

Nothing in this section prevents either party from seeking emergency or injunctive relief where legally appropriate.

Any arbitration agreement, class-action waiver, or other mandatory alternative dispute-resolution provision should apply only if expressly stated in legally enforceable terms presented to users.

39. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

The invalid provision will be interpreted or modified only to the extent necessary to make it enforceable where permitted.

40. No Waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

41. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or similar business transaction, subject to applicable law.

42. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly presented in connection with a particular feature or subscription, constitute the agreement between you and Becca’s Rental List concerning your use of the Service.
